Tenth Circuit's Decision in Marriage Equality Case a Monumental Moment for Equal Justice

Today, the U.S. Court of Appeals for the Tenth Circuit handed down its decision in Kitchen v. Herbert. In a 2-1 decision for a three judge panel, the Tenth Circuit upheld the lower court's finding the Utah's ban on marriage between same-sex couples violates the Fourteenth Amendment of the U.S. Constitution. The decision stats that "those who wish to marry a person of the same sex are entitled to the exercise of the same fundamental right as it is recognized by persons who wish to marry a person of the opposite sex."
