Is obesity a “per se” disability? One court says no.

A panel of the U.S. Court of Appeals for the Eighth Circuit ruled this week that obesity is not a “disability” within the meaning of the Americans with Disabilities Act — even as amended in 2009 — unless the condition was caused by some underlying physiological disorder.

Hooters Sued for Weight Discrimination

It’s news to us, but evidently weight discrimination is a cause of action, at least in Michigan.
Hooters was sued today in Michigan for allegedly violating a state law that bars discrimination on the grounds of religion, race, age, sex, height and, yes, weight. (Here’s a copy of the law.)
