VETS100 FILING DEADLINE EXTENDED
2011 VETS 100 Filing Cycle
The filing deadline for VETS-100 reports in the 2011 cycle has been extended to January 15, 2012. At that time the VETS-100 application will be removed from public service until further notice.
Any users experiencing difficulty processing their reports in the application are encouraged to send their data to the VETS-100 Service Desk in paper or in the batch upload electronic file format. The maximum number of paper submissions a company can submit has been increased to 30. All paper reports and electronic files received at the Service Desk by January 15th will be included as part of the 2011 filing cycle and will not be considered late.
Contracting Officers should not withhold from obligating funds to contracts because a contractor has not filed a report for the 2011 filing cycle because the 2011 filing cycle is still open. Any report submitted after January 15, 2012 for the 2011 filing cycle may be handled by a contracting officer according to VETS 100/100A regulations.

To address this delay, contractors may choose to submit the VETS 100/VETS 100A reports by email or hard copy for the 2010 filing cycle so that federal contracting officers may obligate funds to a contract. This filing process is further described below in the "File for 2010 Cycle". Contracting officers should not withhold from obligating funds to contracts because a contractor has not filed a report for the 2011 filing cycle, as the 2011 filing cycle has yet to occur. The timeframe for information used to complete a VETS100/100A report (known as the "reporting period") will still remain the same, despite the change to filing cycle timeframe (August 1 to November 1). Contractors will have up to 60 days from the time the system is operational to submit their report which is expect to begin on November 1, 2011 and end December 30, 2011.

However, we were not able to address all the technical problems required to bring our system online by this date. We are confident that we will have the system up and running by November 1, 2011.To address this delay, contractors may choose to submit the VETS 100/VETS 100A reports by email or hard copy for the 2010 filing cycle so that federal contracting officers may obligate funds to a contract. However, there are currently technical problems preventing contractors from carrying out these submissions. The Department is aware of this issue and is working to correct it, and anticipates having the problem resolved within the next 60 days. Accordingly, the Department anticipates that the electronic filing system will go online October 1, 2011.
To address the delays in reporting caused by these technical problems, the Department will not initiate enforcement actions against contractors who submit the VETS-100/VETS-100A from October 1, 2011 through November 30, 2011. Unless a further update is given or other recognized exceptions apply, the Department may initiate enforcement actions against contractors who do not submit VETS-100/VETS-100A forms by November 30, 2011.

SCOTUS Decides Schindler v. U.S. ex rel. Kirk (VETS-100 issue)

We blogged about this case one year ago when the Second Circuit ruled in favor of Mr. Kirk. Here's how we described the case back then:
Daniel Kirk, a Vietnam War veteran, worked at Millar Elevator Industries beginning in the late 70s. In 2002, Millar's operations were integrated into those of the Schindler Elevator Company. In 2003, Millar was demoted and resigned. Eight months later, Kirk sued, alleging that he had been fired in violation of VEVRAA, the VIetnam Era Veterans Readjustment Assistance Act. That claim was dismissed and the dismissal was affirmed last year.
Meanwhile, Kirk brought suit under the False Claim Act in the name of the U.S. government. In 2007, the government elected not to intervene and Kirk pursued his claim as a relator. His suit alleged that Schindler had entered into hundreds of contracts subject to VEVRAA requirements but that Schindler had failed to comply with those requirements. Among other claims, Kirk alleged that Schindler failed to submit required VETS-100 reports in some years and had filed false VETS-100 forms in others. The district court dismissed the action finding, among other things, that the claim was bared under the FCA, 31 U.S.C. s. 3730(e)(4), which provides that information that has been publicly disclosed cannot be a basis for a FCA claim. The information at issue here related to the allegedly missing and/or falsified VETS-100 forms that Mr. Kirk had discovered through FOIA requests.

Electronic compliance report isn't helping veterans get jobs

Everybody loves veterans.
Holidays are named for them. Parades are devoted to them. Politicians of all stripes make a public display of embracing them.
But when it gets right down to how Uncle Sam serves former service members, the picture can get murky.
Testimony submitted for a congressional hearing last week demonstrated that employment of veterans with companies that do business with the federal government is an area that leaves much to be desired.
The House Veterans' Affairs subcommittee on economic opportunity heard witness after witness describe serious weaknesses with the government's oversight and enforcement of affirmative action laws and regulations designed to promote employment of veterans with private contractors.

VETS-100 SPECIAL NOTICE FOR FEDERAL CONTRACTORS:Due to the high volume of calls, the VETS-100 helpdesk’s telephone lines and email box are overloaded. Federal contractors who can’t reach the helpdesk for assistance have until October 31, 2009 to file their VETS-100 or VETS-100A Report(s). We encourage every contractor not to wait until the 31st to file. If a company cannot file the report(s) by October, 31, 2009, it can request additional time to submit its report(s) to rkaiser@vets100.com. This email address will respond to only requests for extensions beyond October 31, 2009, and will be considered on a case-by-case basis.

VETS-100 FORM DUE SEPTEMBER 30TH FOR SOME FEDERAL CONTRACTORS
The Federal Contractor Program requires that any contractor receiving a contract before December 1, 2003 from the federal government in the amount of $25,000 or more, or any subcontractor receiving a contract in the amount of $25,000 or more from such a covered contractor must file a VETS-100 Report on an annual basis. In addition, any federal contractor or subcontractor is also required to take affirmative action to hire and promote qualified special disabled veterans, veterans of the Vietnam-era and any veterans who served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized. The filing deadline is September 30, 2008. Employers can file reports at the DOL’s Web site or submit a diskette in the data format specified by the DOL.
