EEOC Seeks OMB Approval to Renew UGESP for Three Years

Agency will not finalize questions on Internet Applicant

In the March 25, 2008 Federal Register, the Equal Employment Opportunity Commission (EEOC) reports that it requested OMB approval under the Paperwork Reduction Act to continue the Uniform Guidelines on Employee Selection Procedures (UGESP) without change for three more years. Under the Act, agencies that collect information from the public, including EEO reporting information, must receive approval from the Office of Management and Budget for such collection authority. Of interest is the fact that EEOC will not finalize the five additional Questions and Answers that clarify the definition of "applicant." Employers must ensure that they are complying with the requirements of UGESP, however.

In view of EEOC's responsibilities to enforce Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act, it will continue to study when and whether it will issue more clarification of the applicant question in light of employers' and applicants' use of the Internet and other technologies. http://edocket.access.gpo.gov/2008/pdf/E8-5903.pdf
