OFCCP Sends Out Large Round of Corporate Scheduling Announcement Letters with a New Twist

San Ramon, CA (PRWEB) May 15, 2012 Two different types of advance notification letters sent to 2000 employers slated for audit San Ramon, CA (PRWEB) May 15, 2012 eQuest Compliance Update - The Office of Federal Contract Compliance Programs has sent out a new round of Corporate Scheduling Announcement Letters ("CSALs") to 2,000 employers identifying establishments slated for compliance review during OFCCP's current fiscal year, ending September 30, 2012. The CSALs provide employers advance notice of the locations slated for OFCCP audit. The CSAL does not initiate an audit. It identifies the location or locations that likely will undergo audit. Only after the employer receives a "scheduling letter" initiating an audit must it respond within 30 days by submitting its affirmative action plan to OFCCP. OFCCP Continues to use CSAL for advance notice of reviews

AAAA has learned that OFCCP will continue sending Corporate Scheduling Announcement Letters (CSALs) as advance notice for establishments that have been identified for potential compliance reviews. The OFCCP has stated that the next round of CSALs will be mailed out in the next two months.

CSALS are defined by OFCCP as:

notification to a corporation that two or more of its establishments are on
the list of contractor establishments selected to undergo a compliance
evaluation during the scheduling cycle. The list is generated from OFCCP's
Federal Contractor Selection System (FCSS). It is not a letter scheduling a
compliance evaluation. The purposes of the CSAL are to:
Provide the
contractor's internal EEO staff notice to obtain management support for EEO and
self-audit efforts;
Encourage contractors to take advantage of OFCCP
compliance assistance offerings;
Encourage contractors to focus on
self-audit efforts that, if problems are adequately analyzed and corrected,
saves OFCCP time/resources when we do an evaluation; and
Help contractors
manage/budget the amount of time required for evaluation activity.

The CSAL is not the official scheduling letter that is sent when an establishment has been selected for a compliance evaluation.

For more information about CSALS, go to the agency's website at: http://www.dol.gov/ofccp/regs/compliance/faqs/csalfaqs.htm#Q2

Second FY 2009 Scheduling List Released

U.S. Department of Labor
Office of Federal Contract Compliance Programs
Announcement of 2009 CSAL

The first list of supply and service contractor establishments will be available to OFCCP regional offices beginning the week of March 9, 2009 for scheduling of compliance evaluations during this scheduling cycle (currently, October 1, 2008 through September 30, 2009).

This release includes approximately 5000 facilities that have either self-identified as being an establishment of a Federal contractor, or have been identified as such by OFCCP. OFCCP generated this list through its Federal Contractor Selection System (FCSS) using multiple information sources and analytical procedures to select contractors for evaluation, including a mathematical model that ranks Federal contractor establishments based on an indicator of potential workplace discrimination. The list also includes a number of establishments identified through external Federal contract databases as part of OFCCP's Contracts First Initiative.

The list excludes establishments based on a variety of factors, including, for example, establishments that are currently undergoing a compliance evaluation, were evaluated within the last 24 months, or have received the Secretary of Labor's Opportunity Award or an Exemplary Voluntary Efforts Award within the last three years. Additionally, Federal contractor establishments covered by Functional Affirmative Action Program (FAAP) agreements with OFCCP and those subject to a Corporate Management Compliance Evaluation (CMCE) are selected for evaluation through a separate process.
